1. Who we are

These terms govern your use of brazierlabs.com and, together with the applicable store terms, the applications published by Brazier Labs LLC (“we”, “us”), 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States. By using the site or our applications you agree to them.

2. Using this website

The site is provided for information about the company and its products. You may browse it, link to it and quote it with attribution. You may not attempt to disrupt it, probe it for vulnerabilities other than as described under security reporting on the Support page, or misrepresent its content as your own.

3. Our applications and purchases

Our applications are distributed through the Apple App Store and Google Play. When you download one, the store’s own terms and standard licence apply alongside these terms, and the store — Apple or Google — processes the payment for any purchase, in-app purchase or subscription.

We grant you a personal, non-exclusive, non-transferable licence to use each application on devices you own or control, as permitted by the store’s usage rules. You may not copy, modify, distribute, sell or lease any part of our software except where the law expressly permits it despite this limitation.

Refunds are handled by the store that took the payment; the Refund Policy explains how to request one.

4. Intellectual property

The content of this site, the Brazier Labs name and our applications are the property of Brazier Labs LLC. Apple, App Store and iOS are trademarks of Apple Inc.; Google Play and Android are trademarks of Google LLC. Nothing here grants you a right to use any of these marks.

5. Third-party stores and links

Where the site links to third-party pages — for example a store listing or a store’s refund page — those pages are operated by their owners under their own terms, and we are not responsible for their content.

6. Disclaimers

The site and our applications are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the site or an application will be uninterrupted or error-free.

7. Limitation of liability

To the fullest extent permitted by law, Brazier Labs LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the site or our applications. Where liability cannot be excluded, our total liability is limited to the amount you paid us for the application concerned in the twelve months before the claim, or one hundred US dollars, whichever is greater. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you; nothing in these terms limits rights that consumer law grants you and does not let us exclude.

8. Governing law

These terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules, and disputes belong to the state or federal courts located in New Mexico — except where the consumer-protection law of your place of residence gives you a right to a different forum.

9. Changes to these terms

When these terms change, the new version is published on this page with an updated date. Continued use of the site or our applications after a change means you accept the revised terms.
